Abstract:

Purpose. Substantiation of the need and development of proposals for improving the national regulatory and legal framework in the field of ensuring the rights and freedoms (RF) of internally displaced persons (IDPs), based on international experience. The objectives are to define the forms and directions of the RF of IDPs; to increase the consistency of the Ukrainian regulatory system of the RF of IDPs and international legal standards; to propose changes to the legal norms in the field of the RF of IDPs.

Methodology. The hermeneutic method was used for the terminological improvement of national regulatory and legal acts. The axiological method allowed comparing international and national legal documents. The method of scientific objectivity allowed identifying problems of the normative regulation of the RF of IDPs and offering recommendations for eliminating these problems.

Findings. It is proved that the RF of IDPs has a broader meaning than legal protection due to its importance for social security. Detailed directions of threats to social security due to improper RF of IDPs are identified. Directions of application of international experience of RF of IDPs are specified. Forms of the RF of IDPs are determined. It is proposed to apply diplomatic support to the formation of an international cluster aimed at assisting Ukrainian IDPs. To eliminate the problem of inconsistency of state structures for the protection of IDPs, it is proposed to expand the scope of the Commissioner for IDPs and to form the Office of the Commissioner for IDP Issues. Measures are proposed to improve the national regulatory and legal field in the sphere of RF of IDPs. Amendments to legal norms in the field of IDPs are recommended.

Originality. It is proven that the repeated relocation of IDPs is an indicator of improper organization of the process of their displacement and an insufficient level of ensuring their rights. It is indicated that without the adaptation of procedural norms to international standards and constant changes in legislation, the imperative requirement to ensure the principle of justice significantly complicates the judicial process, as it requires judges to choose the path infra legem or the path praeter legem.

Practical value. The proposed changes to legal norms will increase the effectiveness of protecting the RF of IDPs.
